By engaging SEOX.com.my ("we", "us", "our") for SEO and digital marketing services, you ("Client") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not engage our services.
SEOX.com.my provides search engine optimisation (SEO), AI visibility optimisation, content marketing, and related digital marketing services. The specific scope of services for each engagement is defined in a separate Service Agreement or Proposal provided to the Client prior to commencement.
Monthly retainer fees are invoiced at the start of each month and are due within 14 days of the invoice date. Project fees are invoiced as agreed in the Service Agreement. Late payments may attract an administrative fee of 1.5% per month on outstanding balances. We reserve the right to pause services for accounts more than 30 days overdue.
Search engine rankings are determined by third-party platforms (Google, Bing, and others) whose algorithms we do not control. SEOX.com.my makes no guarantee of specific ranking positions or traffic volumes. Any improvements discussed during consultations represent reasonable expectations based on experience, not contractual commitments. No ethical SEO provider can guarantee rankings.
Clients agree to:
Content, strategies, and deliverables created by SEOX.com.my remain our intellectual property until full payment is received. Upon full payment, all work product created specifically for the client becomes the client's property. Our proprietary methodologies, frameworks, processes, and templates remain our exclusive intellectual property at all times.
Both parties agree to keep confidential any non-public information shared during the engagement. This includes client business data, competitive strategy, pricing information, and any information designated as confidential by either party. This obligation survives termination of the engagement.
Either party may terminate a monthly retainer engagement with 30 days written notice via email. Project engagements may be terminated as per the specific terms in the Service Agreement. Fees paid for work already completed are non-refundable. Upon termination, all client assets and access credentials will be returned within 7 business days.
SEOX.com.my's total liability under any engagement is limited to the fees paid in the three months preceding any claim. We are not liable for indirect, consequential, incidental, or punitive damages, including loss of revenue, loss of data, or business interruption arising from our services or any changes to search engine algorithms by third parties.
The Client agrees to indemnify SEOX.com.my against any claims arising from the Client's content, products, services, or business practices, including any claims that the Client's website content infringes on third-party rights.
These Terms of Service are governed by the laws of Malaysia. Any disputes arising from these terms or the provision of our services shall be resolved in the courts of Malaysia, with Kuala Lumpur as the jurisdiction.
We reserve the right to update these terms at any time. Active clients will be notified of material changes with 30 days advance notice via email. Continued use of our services after the effective date constitutes acceptance of the updated terms.
